Definitions

DPhE’s Privacy Policy is based on the terms used by the European legislator when enacting the General Data Protection Regulation (GDPR). Our Privacy Policy is intended to be easily readable and understandable for both the public and our customers and business partners. To ensure this, we would like to explain the terms used in advance.

  7. Controller
    Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
  8. Processor
    Processor means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
  9. Recipient
    Recipient means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.
  10. Third party
    Third party means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.
  11. Consent
    Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Job Application

We offer you the opportunity to apply to us (e.g., by email, post, or via an online application form). We assure you that the collection, processing, and use of your data comply with applicable data protection law and all other legal provisions, and that your data will be treated with strict confidentiality.

If you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes from job interviews, etc.) to the extent necessary for deciding on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation) and – if you have given consent – Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If the application is successful, the data you submitted will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of carrying out the employment relationship.

If we cannot offer you a position, you decline a job offer, or withdraw your application, we reserve the right to retain the data you submitted for up to 6 months from the end of the application process (rejection or withdrawal of the application) based on our legitimate interests (Art. 6 para. 1 lit. f GDPR). Afterwards, the data will be deleted and physical application documents destroyed. This retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period (e.g., due to an impending or ongoing legal dispute), deletion will only take place when the purpose for further retention ceases to apply.

Longer retention may also occur if you have given corresponding consent (Art. 6 para. 1 lit. a GDPR) or if legal retention obligations prevent deletion.
